ACKNOWLEDGEMENT OF DANGEROUS ACTIVITY
AND WAIVER
In consideration for my being permitted to participate in any way in pentathlon multisport events, being events comprising any combination of swimming, shooting, running, obstacle course racing and fencing (the Activity), I, and if I am not yet 18, my parents or legal guardians, agree to be bound as follows (and the term "I" In this release refers to both the athlete and their parents/legal guardians):
1. Acknowledgement and Assumption of Risks. I understand, acknowledge and accept that pentathlon multisport events involve the real risk of serious INJURY, Including permanent disability, paralysis and death,which may be caused by the athlete's actions or inactions, those of others participating in the Activity, the conditions in which the Activity takes place, the negligence of the Released Parties named below, lack of fitness or conditioning, or other causes. I further understand there may be other risks either not known to me or not readily foreseeable at this time. I voluntarily assume all risks and all responsibility for losses, costs and damages that may result from my participation in the Activity).
2. Use of substances. I understand and acknowledge the dangers associated with the consumption of alcohol or any mind-altering drugs and agree not to drink alcohol or take drugs prohibited by law before or during the pentathlon multisport event.
3. Rules and directions. I agree to comply with all posted rules and to heed all warnings during the event. I also agree to follow the directions of any event organiser or official and acknowledge that any misconduct or refusal by me to follow any direction of any organiser or official may result in the cancellation of my participation and my immediate removal from the pentathlon multisport event, no matter where that may occur.
4. Release. I release Modern Pentathlon - Victoria Inc., Modern Pentathlon Australia and their respective officers, employees, contractors and volunteers, and the owners or lessees of any facilities within the Activity is conducted and their respective officers, agents and employees, and all other persons providing facilities or assisting In the conduct of the Activity (collectively, the Released Parties) of and from any claims, demands, liability, losses or damages of whatever name or nature, Including but not limited to those arising from or In any way related to the negligence of any of the Released Parties, that arise out of or are connected In any way with my participation In the Activity (collectively, the Released Claims).
5. Indemnity. I will defend, indemnify and hold harmless the Released Parties from (that Is, to reimburse and be responsible for) any loss or damage, including but not limited to costs and reasonable attorney's fees (Including the cost of any claim I might make or that might be made on my behalf that is released in this document), arising out of or connected in any way with any of the Released Claims.
I have read and agree to abide by Modern Pentathlon Australia's Code of Conduct (available at https://cdn.revolutionise.com.au/site/dghv0kxmwp6izeym.pdf) and other relevant policies applicable to the Activity.
I have read and understand this Dangerous Activity Acknowledgement and Waiver. I also understand that by entering the event, I accept the terms set out in this document. I understand that I am giving up substantial rights, and I do so freely and voluntarily with full knowledge of its significance.
For Participants of Minority Age (Under Age 18)
As a parent/guardian with legal responsibility for this participant, I acknowledge, understand and accept ALL OF THE ABOVE and consent and agree to my child’s involvement or participation in the Activity.
